Distance Contract

1. Terms used

1.1. LeldeMD - Service provider, self-employed person Lelde Clemente, hereinafter - LeldeMD provides remote services in the Internet environment (hereinafter: Service) to its Buyers.

1.2. Buyer: Recipient of the service or goods - a customer who has paid in full or in part.

1.3. Consultations: Services provided by LeldeMD including, but not limited to: individual consultations, training programs, courses, master classes, question and answer sessions.

1.4. Description of consultations: a web page specially created for the Consultation program, which mentions, but is not limited to, the name of the Consultation, the purpose and expected benefits, the duration/time plan, Tuition fees, payment conditions.

1.5. Tuition fee: fee for Consultations.

 

2. General Terms of Consultation

2.1. LeldeMD grants users the right to view, use, listen to and read the consultation material, but retains all property and copyright rights to this material.

2.2. Buyers may not modify, reproduce, share or distribute the materials. You may use the materials only for your own needs - do not sell them, give them to others or make them publicly available to other persons in any way.

2.3. LeldeMD reserves the right to terminate cooperation with the Buyer if misleading, inaccurate and/or incorrect information is provided, as well as if the Service recipient or the Buyer behaves unethically, inconsistent with these rules, or in LeldeMD's opinion, its behavior may mislead or interfere with cooperation with other Buyers. In such a case, cooperation may be terminated without providing explanations and without refunding the paid fee for Consultations.

2.4. LeldeMD reserves the right to change the scheduled time of Consultations, with prior notice.

2.5. LeldeMD informs the Consultation participant about the confirmation of registration.

2.6.LeldeMD sends the Consultation materials to the e-mail specified by the Buyer - this means that the delivery of the digital Consultation service has started. Consultation materials may initially be available in full or in part, according to the Consultation plan and the rules mentioned in the Consultation description.

2.7. LeldeMD reserves the right to unilaterally cancel or postpone partially or fully the planned Consultation due to, for example, health conditions or other technical reasons. in such case, the tuition fee paid is returned in proportion to the part of the Counseling canceled.

2.8. The content of the consultation program and LeldeMD's social media is created with good intentions and taking into account the information available to it, however, LeldeMD is not a medical institution of any kind, it shares its opinion, experience and provides recommendations, while it is the Buyer's responsibility to constantly evaluate the suitability of the proposed recommendations for their situation and seek medical attention when necessary. LeldeMD advises Buyers to act prudently and does not assume any responsibility for Buyers' results or well-being (neither mental, emotional, physical, etc.) when applying one or more of the recommended methods.

 

3. Payment terms

3.1. The price for Consultations is indicated in euros, including value added tax (VAT).

3.2. Payment for Consultations is made by bank transfer.

3.3. Payment for the Consultations must be made as a prepayment in full, following the provisions of point 3.4.

3.4. For individual Consulting programs, the payment can be divided into several payments, if this is indicated in a specific Consulting description. In this case, the full payment amount for the Consulting Program may differ from the price if it were paid in one payment.

3.5. In the case of split payments, the Buyer's access to the study materials will be immediately terminated if the payment date is not observed.

3.6. Money is not refunded or deducted from Tuition for late or missed classes, however, if it is provided for in the Counseling program description, a Counseling record may be available.

3.7. LeldeMD reserves the right to announce price reduction promotions or discounts at its discretion. The prices of the Services may change, but such changes will not have an impact on already concluded Agreements, except if the price increase is directly related to VAT or other significant cost components.

3.8. The paid tuition fee is returned in full, in the event that LeldeMD exercises its rights specified in clause 2.7.

 

4. Consumer's right of withdrawal

In the case of consultations:

4.1. The Buyer-Consumer has the right to use the right of refusal established by law, and within 14 days from the moment of full payment or the moment of the first payment, refuse the Consulting service only in cases where the delivery of the Consulting service, neither in full nor in part, has not yet been started during this period.

4.2. The consumer who wants to withdraw from the contract in the case of Consulting services is obliged to send the Seller a completed request in a free form/or an attached form, which would outline the decision to withdraw from the Contract, within the deadline specified in clause 4.1. Upon receiving the Buyer's notification, the Seller immediately sends a confirmation of receipt of the notification. In that case, the paid Tuition fee is returned in full.

4.3. The Buyer - Consumer agrees and confirms that he waives his right of withdrawal as soon as the delivery of the Consulting service - materials has started. The delivery of the consultation service is considered to have started as soon as the Buyer has been provided with the opportunity to access the consultation materials, in accordance with the procedure set out in Part 2.

5. Others

5.1. LeldeMD reserves the right to amend the Terms of Use at any time, the amendments become effective upon their publication on the Portal.

5.2. All notifications sent via e-mail are considered delivered to the Buyer 24 hours after the notification is sent.

5.3. The e-mail address is used, among other things, for sending invoices and other notifications related to the provision of the Service.
